AGREEMENT TO OUR LEGAL TERMS

We are Delve Gallery ("Company," "we," "us," "our").

The legal terms set out below constitute a legally binding agreement made between you, (the “customer” or “buyer"), and Delve Gallery, concerning your access to and use of the website and services. You agree that by accessing the website or ordering any of goods, you have read, understood, and agreed to be bound by all these legal terms.

IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, THEN YOU ARE PROHIBITED FROM USING OUR SERVICES AND YOU MUST DISCONTINUE USE.

Delve Gallery will alert you about any changes to this policy by updating the "Last updated" date on these legal terms. You are waiving any right to receive specific notice of such change. It is your responsibility to review these legal terms and to stay informed of any updates.

 

INTERPRETATION

Contract means the legally-binding agreement between you and us for the sale and purchase of the Goods;

Goods means any goods that we supply to you, of the number and description as set out in the order;

Order means the customer’s order for the goods from the supplier as set out in the customer’s order or in the customer’s written acceptance of the supplier’s quotation.

  1. OUR WEBSITE

The website and our terms are governed by the laws of Scotland (see Section 5).

Any individual or entity who chooses to access our website from locations outside of our jurisdiction do so on their own initiative and are individually responsible for adhering to local laws, if and to the extent that these laws are applicable.

  2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or have been given express permission by the owners of all intellectual property rights in our Services. This includes but is not limited to all website designs, video, audio, text, photographs, and graphics on the website, as well as the trademarks, service marks, and logos contained within the website. Our content is protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws). The content is provided in or through the website and services for your personal and non-commercial use only – unless permission is expressly granted.

  3. PROHIBITED ACTIVITIES

You may not access or use the website for any use other than that for which we make it available. The website may not be used for any commercial endeavours except those that are expressly endorsed or approved by Delve Gallery.

  4. MODIFICATIONS AND INTERRUPTIONS

Delve Gallery reserves the right to modify, change or remove the contents of the website and/or services at any time, without any notice or for any reason at our discretion. Neither do we have any obligation to update any information on website and/or services.

  5. GOVERNING LAW

These legal terms shall be governed by and defined following the laws of Scotland.

  6. USER DATA

We will maintain certain data that you pass to the website and services for the purpose of managing the performance of the website. Please see our Privacy Policy for further details.

  7. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the website, sending us emails, and completing online forms constitute electronic communications. You are consenting to receive electronic communications, and you are agreeing that all notices, disclosures, and any other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing.

  8. GOODS

The description of our goods is set out in our catalogues, brochures, website, and other forms of advertisement. There may be minor discrepancies in colour or size.

If we are making goods to the customers special requirements, it is the customers responsibility to provide accurate information.

  9. SALES

Delve Gallery acts as the Seller of any goods (unless otherwise stated).

Once an order has been made it can be rejected by us for any reason – of which we would advise the customer without delay.

Any quotation will be valid for x days, unless we expressly withdraw it prior to then.

Any variations in contract must be agreed by Delve Gallery, the artist(s), and the customer in writing.

Artists or their employees are not authorised to make any representations concerning the goods unless confirmed by us, the seller, in writing.

We will endeavour to describe and display goods as accurately as possible. However, as all items are original and bespoke, the exact size and colour of goods may differ slightly from the information listed on the Delve Gallery website. We cannot guarantee the colours of the goods will exactly match those displayed on the customers personal screen.

  10. PRICE AND PAYMENT

Price and Tax

All prices include UK VAT within the price – most goods and services in the UK are charged VAT. The Customer is responsible for all other taxes which may be applicable to the territory they request the goods to be sent to (including but not limited to any custom duties).

If you would like a copy of your VAT receipt please email delve@gmail.com and we can send this.

Payment must be made at the time of the customer placing the order. The contract is in force one payment is made.

Payment by card

All debit/credit transactions are powered by *

Your card details are held only by these respected payment services and by your bank, never by Delve Gallery.

We accept all major debit/credit cards, including:

We also accept Google Pay and Apple Pay.

Own Art

Customers in the United Kingdom can make use of the Own Art scheme, an interest free finance option for items over £250. You can pay back the value of the item over the period of 10 months (up to the value of £2,500). If the item is valued at more that £2,500 then the excess can be paid upfront.

Acceptance to the scheme is subject to a credit check. Please read more on the Own Art website – www.ownart.com

  11. DELIVERY

UK delivery is free for all paintings.

Goods will be delivered using either an Art Courier or regular postage at the discretion of Delve Gallery. Goods will be shipped to the address we receive at the time of purchase.

Delve Gallery will endeavour to have orders processed and shipped within x days. The buyer will receive a confirmation of postage with shipping details at the time of shipment.

In the unlikely event that we are not able to fulfil your order within this period we will contact you to inform you and advise on a shipment date.

We are happy to ship goods abroad where possible. We would arrange shipment and cover packaging costs, the buyer would be responsible for shipping fees. If you would like your order to be shipped to a country outside of the United Kingdom, please contact us at delve@gmail.com with the details of the goods you would like to order and we will contact you with a shipping quote.

  12. RISK OF DAMAGE

We will take every care to ensure that your purchase is packaged securely to prevent damage during transit and to ensure that your artwork arrives in perfect condition.

The buyer must inspect the goods on arrival and inform Delve Gallery in the unlikely event of any damage within 24 hours.

Risk of damage or loss of goods will pass to the buyer on the receipt of the goods, if full payment has been made and goods have arrived in an undamaged state.

  13. RETURNS, REFUNDS, EXCHANGES AND CANCELLATIONS

The customer has the right to return purchased goods within 14 days of receipt. They are eligible for a refund or exchange.

Please email delve@gmail.com within 14 days of receipt with the following information:

  1. You order number
  2. Artist and title
  3. Reason for return
  4. Requesting wither an exchange or refund

All goods must then be returned in the original packaging and state by following the return information which will be emailed on receipt of the above information.

Upon receiving the returned goods, we will process your refund within x days.

For shipments which are being returned from a country outside of the United Kingdom, shipping (inbound and outbound) will be deducted from the refund.

Customers/buyers may request a cancellation of an order by emailing delve@gmail.com within 12 hours of purchase. Depending on whether the item has been shipped, we may refund the buyer immediately or advise the buyer to follow the above returns policy.
